Atlantahobby.com, Inc. ("Atlanta Hobby")
Customer Agreements and Warranty Waivers
- Customer and anyone using this product acknowledges that it is customer's and user's responsibility to use same carefully and properly, and in compliance with all guidelines, rules, laws and regulations of all federal (including, but not limited to the FAA), state and local governments; that it is the customer's and user's responsibility to become fully knowledgeable with all systems with respect to this product and related equipment before using same. As for flight products, it is customer's and user's responsibility to obtain proper flight training from a qualified instructor prior to any operation.
- Customer and user understand that all flight products move through the air and can crash, resulting in damage or complete destruction of the product, and possibly injury to persons. Neither Atlanta Hobby nor any manufacturer of the product or any of its component parts shall be responsible for any damage resulting from a crash or collision, and customer and user hereby waive any and all claims for damage or injury arising from or related to any such crash or collision; and customer and user hereby indemnifies and holds Atlanta Hobby harmless for any and all such damages or injuries.
- Customer and user are fully responsible for the product's operation, and hereby release and hold Atlantahobby.com, Inc. (its officers, employees, agents and directors) and any manufacturer of the product (or any of its component parts) harmless for any damages or injury arising from the use or operation or attempted use or operation of this product. Customer and user hereby agree to indemnify and hold Atlantahobby.com, Inc., its officers, directors, agents and employees harmless from and against any and all claims, damages, injuries, losses or expenses (including, but not limited to attorneys fees) arising from or related to the use or operation this equipment or product.
- Customer and user accept this product or any product serviced or repaired by Atlanta Hobby "as is, where is," and understand and agree that Atlantahobby.com, Inc. disclaims any and all warranties, express or implied, including, but not limited to, the implied warranties of merchantability or fitness for any particular use or purpose.
- To the extent any manufacturer's warranty is assignable, same is hereby assigned to customer without recourse; and customer hereby agrees that Atlantahobby.com, Inc. shall not have any liability whatsoever regarding any such manufacturer's warranty or the assignment or attempted assignment thereof.
If the foregoing terms are not acceptable and agreed to by customer, the product or equipment is to be returned to Atlantahobby.com, Inc. unopened, and a full refund will be issued (less any shipping and packing expense). Failure to return the equipment unopened, or the use or attempted use of the product, shall constitute acceptance by customer and user of the above terms and conditions.
